How a Sullivan County DUI case moves

  1. Arrest and booking. Bristol Tennessee police, Sullivan County deputies, and state troopers book DUI arrests, generally at the Sullivan County jail in Blountville. Bond is set before release.
  2. No DMV hearing. Tennessee does not run a separate administrative license hearing after a DUI arrest. The court decides license consequences.
  3. First appearance. In Sullivan County General Sessions Court; for Bristol arrests, usually at the Bristol Justice Center on Anderson Street. If you refused a test, the refusal can be decided here or with the DUI case (Tenn. Code Ann. § 55-10-406(d)(4)).
  4. Resolution or bind-over. A misdemeanor DUI can be resolved in General Sessions. A case can also be bound over to the grand jury and go to Criminal Court in Blountville.
  5. After a conviction. Jail time must begin within 30 days of conviction or when space opens (§ 55-10-402(f)); a driving prohibition of one year or more; possibly a restricted license with an ignition interlock and SR-22 insurance. The Sullivan County DUI guide has each step.

Your license, the restricted license, and the interlock

There is no administrative license hearing to request after a Tennessee DUI arrest. A conviction brings a court-ordered driving prohibition of one year on a first offense (Tenn. Code Ann. § 55-10-404), and a refusal finding brings a separate revocation of at least one year (§ 55-10-407).

A judge can order a restricted license for many drivers (§ 55-10-409). The Tennessee Department of Safety says to take the signed order, with SR-22 insurance, to a Driver Services Center within 10 days; in Sullivan County that is the Blountville center listed above. Many restricted licenses require an ignition interlock, kept for at least 365 days or the whole revocation if longer. Interlock installers are in the directory, and the restricted license guide walks through it.

Bristol, Virginia is a different state

State Street is the state line. An arrest on the Virginia side is a Virginia case, in Virginia courts, under Virginia law, and this site does not cover it. For the Virginia side, start with the Virginia Judicial System and the Virginia DMV, and talk with a lawyer licensed in Virginia. More in the state line guide.
